From 2021 to 2025, Guangdong's procuratorial organs will focus on hot-button issues concerning people's livelihoods and key groups, carrying out a special campaign of "Protecting People's Livelihoods," adhering to the principle of giving equal importance to punishment and governance. While punishing malicious wage arrears crimes according to law, they will also promote the resolution of social conflicts, effectively safeguard the legitimate rights and interests of workers, and strengthen judicial protection for people's livelihoods.
Data shows that since 2021, procuratorial organs throughout the province have accepted and reviewed 1,197 cases involving 1,266 individuals for the crime of refusing to pay labor remuneration, approving the arrest of 443 cases involving 447 individuals; accepted and reviewed 1,785 cases involving 2,098 individuals for prosecution, initiating public prosecutions in 769 cases involving 817 individuals; and handled 4,901 civil support lawsuits related to labor disputes, including 3,011 cases supporting migrant workers' lawsuits.
According to reports, the provincial procuratorate comprehensively utilized methods such as designated supervision, leadership involvement in cases, and early intervention to guide investigative agencies in conducting comprehensive investigations and collecting evidence, focusing on elements such as the suspect's identity, ability to pay, and evasion of payment. This approach both intensified the crackdown on malicious wage arrears crimes and adhered to the boundaries of criminal law to prevent the prosecution from "crossing the line."
As early as 2023, the Guangdong Provincial People's Procuratorate, along with 11 other provincial procuratorates including those in Sichuan, Jiangsu, Zhejiang, and Shanghai, jointly signed a cross-regional cooperation mechanism to support prosecution, safeguarding the legitimate rights and interests of migrant workers. A comprehensive support and cooperation mechanism for prosecution has been basically established in all 21 cities of Guangdong.
Notably, the Guangdong procuratorate has focused on strengthening the protection of the rights and interests of workers in new employment forms. In 2024, the Guangdong Provincial People's Procuratorate launched a special campaign to support prosecution for the protection of the rights of workers in new employment forms, with procuratorial organs throughout the province handling a total of 219 cases. For example, the Xinhui District Procuratorate of Jiangmen City, in conjunction with the District Federation of Trade Unions, held a rights protection activity for new business models, gaining a deeper understanding of the rights protection demands of food delivery riders. They handled a case involving a college student working part-time as a courier seeking unpaid wages, and issued a letter of support for prosecution to the court.
Furthermore, Guangdong prosecutors have deepened the application of big data legal supervision models. They fully utilize various data resources, combined with the characteristics of wage arrears cases, to construct big data legal supervision models and accurately screen for leads supporting prosecution. For instance, the Sanshui District Procuratorate of Foshan City used a big data legal supervision model to screen and eradicate more than 10 leads related to wage arrears, successfully establishing and concluding 2 cases supporting prosecution and 1 civil enforcement supervision case.
